Legal Question in Real Estate Law in Texas

Home Builder Misrepresentation

My father in-law is suing his home builder for a not complying with his warranty. He recently purchased a $300,000.00 custom home and the sewer system was not properly installed. Because of the misconstruction that was blatanly overlooked by inspectors, Mr. McCarter has a sewage gas leak in his house. My question is this: It will probably take several months before the case is heard. The stinch is untolerable, and Mr. McCarter is considering fixing the $25,000.00 damage out of his pocket before going to court. Is there a percentage of less return for plantiffs that repair damages before a verdict is returned? Basically, should he expect to recieve less money if he fixes it himself rather than waiting for the verdict?

Thank You.
