Legal Question in Real Estate Law in Texas

Promissory Estoppell

About 13 other family's including mine all bought 5 acre tracks in a sub-division in the sticks. We all were promised the land around us would never be sold, that is why we bought out there. Our neighbor now wants to sell land in front of us in 1-acre tracks with mobile homes on it, about 65 of them. Do we have a case?

Re: Promissory Estoppell

Depends. Was the promise was in writing? Was it in your contract to buy the property or your deed? Was there an instrument recorded that gave a legal description of the land which was to remain vacant and recited that fact? If any or all of these are true, you have a shot. If you only have an oral promise, you have a much topugher case from both a proof and a legal enforcability standpoint.
