How do we sell the house?

My father-in-law owns a house in New Mexico. He is currently in a hospital in Texas and may need to sell his house. According to his doctor, he is not competent to make decisions for himself due to a rapidly worsening dementia (in addition to other health problems). My husband does not have any authority, power of attorney etc. because my father-in-law never set that up. If the house needs to be sold and my father-in-law is not able to sign a real estate contract, what can my husband legally do to help sell it? We reside in Texas.

Where is your father-in-law's legal residence? You will need to go to the probate court in the county of his domicile and have your husband appointed guardian of his estate. Then he will have authority to handle his affairs.
