Legal Question in Real Estate Law in Texas

Tenants in common

My husband and I are tenants in common with our daughter. We live in Michigan. She lives in Texas with her two sons. If she dies and wills the house to her sons, do we still have tenants in common ownership?

Re: Tenants in common

Upon death, the decedent's interest passes to his/her heirs named in the will who then become new tenants in common with the surviving tenants in common.

If your daughter dies, and wills her ownership of the house to her sons, they would become tenants in common with your husband and yourself.
