Legal Question in Real Estate Law in Texas

Right behind me is a vacant lot that belongs to the people that live next to that vacant lot. In the vacant lot they have been riding motor cycles & 4 wheelers. They ride at any time of the day or night. I get up at 4 am to go to work and go to sleep at 9 PM. My husband works grave yard. Each one of us has experienced being woken up by the kids riding these items. We live in a residential neighborhood and we can�t even enjoy our back yard because of the dirt in the air that this hobby produces.

We have called the police and each time we are told that they are in their yard and there is no noise ordinance in affect for our area. But what about my rights as a home owner? I have no rights? These kids have ruined our new fence because of all the dirt and mud that has been slung up on to it, so we are left with our property looking bad.

There has to be something that can stop this insanity. The noise, the dirt, the lose of sleep and stress of hearing people say there is nothing I can do. It is like people are saying to me shut up and deal with it.

What can I do as a home owner??

Contact your local representatives (city councilmember if in a city, if not, then your county commissioner) and complain. Ask them to consider enacting a noise ordinance. If they don't respond, go to that local entity's council meetings or commissioner's meetings and complain further.
