Legal Question in Wills and Trusts in Texas

Contested Marriage

I was living with a man whom was married, we established a home together and had a child, we considered our self as husband and wife, he filed for divorce in December, but was killed in April before the divorce was final, we was together for over 18 months and now the women whom he married but separated from after 2 months, seem to think she is entiled to everything, do I have ane legal rights or can I contest the marriage because she was commiting adultery in their home while he was at work and his father walked in on her and the guy so wouldn't that be grounds to contest her as a wife.

Re: Contested Marriage

Your child is entitled to its portion of your lover's estate. You don't have any claim personally, other than as Next Friend for your child.

I suggest you see an attorney about enforcing your child's claim, if there's anything in the estate worth fighting over.
