Legal Question in Wills and Trusts in Texas

estate in limbo

My aunt died ten years ago. This aunt had one will which was written 40 years before she died, but it was the only one and the one that was probated. My sister was the executrix for the estate, but she died about 3 years later, before the estate was settled. There was a house in the estate, and my sister was legally able to transfer that over over to me to sell under Texas law, but not the whole estate. I did manage to sell the house, but we still have estate items in our house. None of the other heirs want to become the executor, and most of them were very cooperative, but there were a couple who caused problems, but they don't want the responsibilty either, just a say when something is done.

My mother and I are ''defacto'' managers of the estate. My mother is in her eighties, and we are just stuck with all this stuff. Do we have any legal rights concerning these items since all of it is in our possession, or are we destined to stay in limbo?

You should petition the court to appoint an administrator. I'm surprised any judge would allow an estate to remain open for 10 years.
