Legal Question in Wills and Trusts in Texas
father drunk when wrote his will
My father was drunk when he wrote his will. This is obvious because his handwritting gets worse as the document progresses and he has very straight handwriting. I researched the probate code and saw that he fits the term incapacitated. He was a chronic drinker. I he went to rehab twice between 1995-1996 and almost lost his job. He started drinking in 2001 after both of his parents died and the on his death certificate it said that alcohol was a probable cause. My stepmother is a very deceitful person. She used to hit me and their are records in 1998 at police d.She always talked bad of me spreading lies about me to anyone who would listen.she also used to try to come in between me and my father. When my father was drinking it was like dr.jekkel and mr hide. He would cuss me out and hang up on me if I called him while he was drinking. I never knew what he was so mad about. But when he was sober he was different. In the will that he wrote he disinherited me his oly child and blood relative only stating that I would only inherit bonds ironically something that my stepmom couldn;t cash.their 2 friends/neigh sighed it. They owed my dad $1k around that time. She got 1.5. He told me otherwise. what are my chances of winning in %? Cost ?

Re: father drunk when wrote his will
Cost will be between $10-20K to contest the probate which may be able to come out of the estate if you win. Get a good attorney who can examine the evidence and give you "odds" on winning. Best of luck. If he/she doesn't think you can win, you have only lost a little consultation fee.
