Legal Question in Wills and Trusts in Texas
My father just passed away. He had a will and I am the executor. I am joint on one of his bank accounts. Can I use those funds to pay for expenses, like funeral, before the will goes thru probate?

If you are a joint tenant with rights of survivorship as opposed to just an authorized signer on the account, the funds in the account are yours. They are not subject to the probate proceeding. Under Texas law the funds passed to you when he died. You can use your money as you see fit.
