Legal Question in Wills and Trusts in Texas

What form do I need to fill in order to file a petition for probate. Husband passed away without a will and my name is not on his account since we just got married.

Depending upon the size of the estate, you may be able to do it with a small estate affidavit and order. Check with the bank and see what they will require.
