Legal Question in Wills and Trusts in Texas
insurance fraud
Hi, my mother whom was 88 years passed away last monday morning in her home. She lived with this man for over ten years. To my knowledge they were never legally married. He was very secretive about all the legal stuff like insurance policies and other legal matters involving my mothers' belongings. My question is: how can I find out if he in fact had an insurance policy under her name when she died? Thanks.--name removed--

Re: insurance fraud
I am unaware of any national registry of insurance coverage. Although, if you are suspicious, you could institute an action in probate court to become the administrator of your mother's estate (if there was a need for an administration) or you could have a court determine the heirs of the estate, thereby having the property distributed per the Texas intestacy statute. This is assuming (1) that there is no will and (2) that the live-in could not demonstrate that he is a common law spouse.
