property tax on willed house

my wife inherited her moms house in late dec. the will was not prorated until late jan. we have lived in the house since her death. now the property tax people say she cannot homestead the house to reduce taxes because the will was not probated soon enough

They are correct. Until the will was probated, you were living in your mother-in-law's house as of the first of January. You can't homestead someone else's property.
