Legal Question in Wills and Trusts in Texas

Will & Probate

My Aunt recently died. She had no children of her own. She had one step-son and multiple nieces and nephews. One of those nieces is Executor of her will. That same niece is in the will as is the step-son and five additional nieces. As one of those nieces I would like to know if there is a law in place that assures that the Executor must disclose ALL assets and how are the other heirs to know if that total is correct.

Also, there is some sort of ''list'' that the Executor speaks of that she says states that some individuals are to be given certain items. She has not produced such a ''list'' and says that she had to cross out things along the way as my Aunt changed her mind. Items are being given away and I feel that this is improper.

How does the probate process work and what guarantees are in place that my Aunt's wishes will be carried out. Is this ''list'' legal? How can we be sure those were her wishes?

Re: Will & Probate

Sounds like the "executor" is disposing of estate property without probating the will. You can request that the will be probated as an interested person. Of course, the initial expense then falls on you, but you can request reimbursement from the executor. If you don't know how to do this, better get a lawyer if you're serious. Otherwise, all you have is disappointment and complaints. Good Luck.
