Legal Question in Workers Comp in Texas

overtime exampt pay

I am overtime exempt employee (salary) and live in Houston, Texas. Our company was closed for operation for four (4) days due to IKE hurricane and lost of power. Now we were told by the company that either I have to use my earn vacation days to cover those four days pay or I will be short pay for four days. Please advice.

Re: overtime exampt pay

No lawyer should give wholesale concrete "legal advise" over the internet or phone on any subject.

However; based solely on the very limited facts you have provided, the answer to your question is most likely covered by Federal law under the F.S.L.A. (Fair Labor Standards Act). The act is large and can be tedious to read and interpret.

Under teh current administration, Corporate America has gotten used to having it their way and having the law always being in their favor. When it is not, they often times take chances hoping the prolific pro-business Judiciary here in Texas will cover their rears later.

I would be happy to talk to you about this situation by phone and get some more facts. If your company is a large one; we may be able to petition for injunctive relief? Please let me hear from you.
