my boyfriend just got caught by border patrol with illegal re-entry, we want to get married is this possible even not knowing his sentencing yet, and also he is still married to somebody in utah.

Since he is married, he can't marry you until he is divorced.
Based on his criminal and immigration history, he may or may not be able to move to USA as a permanent resident. Before you marry him, you need to consult an immigration attorney about his chances of becoming a lawful permanent resident of USA in the future.
