Legal Question in Business Law in Vermont

Breach of contract on an Internet sale

A company I do business with has a web based ordering system. I used this system to get a quote on materials. I called a sales rep because the price seemed low. The sales rep seemed to think the price was OK. I placed the order through the web site. The web site accepted the order, I billed the customer, and the customer paid me. The company charged my credit card for the product. They then backed out saying that their web site had quoted me the wrong version of the product, and the version I needed was actuall more money. Doea this constitute a breach of contract or something, and are they responsible for selling the right product to me at the quoted price, or do I have to eat the additional cost?

Thanks

Re: Breach of contract on an Internet sale

Since this is a commercial transaction (regardless of the interent based issue), it will be covered under stantard UCC (uniform commercial code regulations). There are a number of issues and exceptions when two commercial enterprises interact, and each case is fact specific. You can get an answer by contacting an attorney who understands UCC law (commercial transactions). My office or another nearby office could help you, but more info. is needed about the specific transaction. How much is the aomount of the transaction? What is the nature of the goods? etc. good luck.
