Legal Question in Credit and Debt Law in Vermont
Car Deposit on Used Car
I am currently a MA resident. I placed a $500 deposit on a car being sold by a private party in VT. We had made a verbal agreement that the deposit would be refundable if I changed my mind. The deposit was made via Paypal. In the text accompanying the Paypal payment it says, ''Here is the refundable deposit on 1987 Saab 900 T Convertible as agreed.'' He never sent anything back to the contrary. No official contract was ever signed.
I know MA has protections for the buyer in this case (MA 940 CMR 5.04) that says ''PURCHASER MAY CANCEL THIS CONTRACT AND RECEIVE A FULL REFUND AT ANY TIME UNTIL S/HE RECEIVES A COPY OF THIS CONTRACT SIGNED BY AN AUTHORIZED DEALER REPRESENTATIVE. PURCHASER MUST GIVE WRITTEN NOTICE OF CANCELLATION TO THE DEALER.''
Anything similar in VT? If we do not reach an agreement, what are my chances in Small Claims Court?

There is a good chance that this may be governed by VT law. Unless the transaction was made in Mass., or you can use the long arm statute to reach the seller, this is the wrong state.

AS I am not licensed to practice law in Vermont, I wouldn't be able to give you an answer.:((
