What hoops do we have to jump through to get married?

My boyfriend, who is here with an h1b, and I are thinking about getting married. What kind of hoops will we have to jump through to do this? Do we have to notify INS before we get married? Thank you.

I wouldn't call them "hoops" but there are certain procedures you will have to go though to gain benefits for you or your husband "after" marriage. I am not familiar with the marriage laws in VT because I practice in NY. However, it is relatively easy to get married in most states in the US, even if you are not a lawful permament resident or a citizen. There are usually no hoops to jump through. Some states require a medical exam for VD or HIV. Some don't. Some states have a short waiting period. Some don't. You just purchase a marriage license at a town or city hall or wherever marriage licenses are issued in the place you plan to marry. You prove that you are of legal age and free to marry (ie single, widowed or divorced), present valid ID & you can marry. BCIS (Immigration) isn't involved in the process unless afterwards, you husband wants a green card. Then, after you marry, you would have to file the appropriate forms and documentation & pay the appropriate filing fees with BCIS to prove that your marriage is bona fide and your husband is admissable to the US. You both will be interviewed.

I am assuming you are permanent resident or citizen. After you get married you can apply for your spouse...by filing I-130 and other forms. If you are citizen...you can file for yor spouses's adjustment of status at the same time you file the spousal petition. Take a look at my site at www.lawyers.com/amyghosh
