Legal Question in Bankruptcy in Virginia
What Is Best
I Know That You Can Only Give Me Advice. I Only Have Credit Card & Doc Bills. My Vehicle Is Paid For. I Went To Credit Cousling Thinking That Would Help. Now Creditors Are Accepting Payments But Are Seeking Judgements Against Me. If I Continue To Make Payments Can They Still Say Oh Well And Freeze My Checking Account. My Paycheck Is Direct Deposit. Would It Be In My Best Intrest To File For Bankrupcy And If So Which One Would You Suggest 7 Or 13.
And If I File Can They Take My Truck OR Personal Property Inside My Home. Thank You

Dear Mr. Sawyer:
Credit counseling does not appear to really done anything for you. If the creditors agreed to your repayment plan, they should have also agreed to forebear on filing suit. Filing bankruptcy will stop the suit, all phone calls, letters, and garnishments. I would need to interview you and review your documents, but depending on your debts and the value of your assets, you may well be able to keep your car and most, if not all, you belongings. Ch. 7 is quick. Ch. 13 is a pay-back plan and takes longer. Call for an appt, 703/883-0016.
