Legal Question in Business Law in Virginia
I purchased a used car yesterday with a 30 day/ 1000 mile warrenty. On the way home the transmission began to downshift roughly with a lot of noise. I called the sales person back and he said it did the same thing when he drove it prior to selling it to me. He made no mention of the problem before I signed the deal. Can I cancel the deal since he misrepresented the vehicle knowingly?

If you did not specifically ask about the condition of the transmission, then
there there may have been no actionable misrepresentation but further facts may need to be disclosed regarding the car's condition as to exactly what you the buyer asked this salesguy and what exactly he told you in response.
In the meantime, however, it would seem highly advisable for you
to take full advantage of your 30 day/1000 mile warranty
to get the problem fixed.
