Legal Question in Criminal Law in Virginia
arraignment
Hello. Court docket information: crime committed 09-05-06, arrest 09-06-06. (This is a repeated offense, occurring several other times in the past.) Destruction private prop and public intox. Bail posted. 1st court appearance ''Arraignment by Clerk.'' 2nd court appearance ''continued.'' 3rd court appearance ''Arraignment by Judge.'' Defendant also waived something but I could not hear what it was. Judge rescheduled for Mar. 14. Three witnesses were sworn in and left courtroom for interview. Question: Why were there two arraignments? Thank you.

Re: arraignment
Probably because the rules likely require that at some point a defendant must be formally arraigned before a judge rather than merely a clerk.
