Legal Question in Criminal Law in Virginia
I was cuaght in the backseat of a stolen vehicle and did not kno the car was reported stolen day before and was kno where near the area and I have witness that say I was some wear eles will that matter in court and can I still be charged

It is always possible to be charged with a crime, even if you are innocent, especially if the police or prosecutor DO NOT KNOW everything or understand everything about the case. It happens all the time. But being charged is not the same thing as being found guilty.
If you have a witness, the most important thing would be for you to get a signed, written statement from that witness. There is always a risk that that witness will change their mind, lose interest, have a conflict of interest or something.
Simply being in a stolen car may not be a problem, but the problem would be if the police believe that you helped to steal it or were part of a conspiracy to steal it.
If your innocence depends upon a witness, don't take any chances. Get a written statement from them somehow.
