Legal Question in Criminal Law in Virginia
Help with harrassment charge?
I have been accused 3 times of harrassing my x girlfriend. The first two have been dismissed. This time she had two warrants issued by swearing a statement in front of the magistate. One is wreckless driving (traffic) and the other harrassment (criminal). She claims I tried running her off the road and was swearing at her. I have witinesses that I was hunting in WV at the same time. Problem: How can I get statements from the witness and use in court without making them travel 4hours to testify?? Since this is the third time she has done this, can anything be done to her for filing a false statement?(how)? She has no witnesses or proof, just her statement. However it keeps costing me money for a lawyer, while she doesn't have pay a dime for the commonwealths attorney. Please Help.

Re: Help with harrassment charge?
You'll need a lawyer for this. Affidavits from witnesses would be inadmissible as hearsay evidence in general district court and therefore your witnesses will have to travel
if your case goes to trial.
Since this is the third time, according to you, in which these false charges have been brought by your ex-girlfriend, with no finding by the court in her favor, you may now have enough to bring and prove a case for malicious prosecution on her part.
