Legal Question in Criminal Law in Virginia

Possession of marijuana

A friend was arrested for possession of marijuana and possession of a firearm. The charges have been taken federal. I know these two charges together will result in a mandatory jail sentence. We are trying to see if we can dispute the marijuana charge. The only marijuana found amounted to maybe a crumb (or residue). Is there a certain amount you must have to be charged with possession? Or are there any other suggestions?

Re: Possession of marijuana

Residues of drugs found on (or near) a person can be sufficient for that person to be charged.

If, as you say, "the charges have now been taken federal", your friend should have an attorney who is knowledgeable and experienced in federal criminal defense matters in the district in which the charges have been brought and one who also has some expertise as well with the all important(and ever changing) U.S. Federal Sentencing Guidelines.
