My son got a uniform summons 4.1-305, Underage drinking. He was a passenger in a car. They were stopped as a suspecious vwhicle. They were not in the possesion of alcohol but when the officer asked him if he had a drink he said yes, earlier at home. The officer did not test him nor did he fine any in possession. Can this hold up in court?

Who knows; your son had best retain an attorney in order to
reasonably ensure that the Commonwealth's evidence has been
tested as to its credibility and as a basis for convicting him beyond
reasonable doubt.
