change of venue

I have moved to chesterfield co VA with my children that I have physical custody of.I have applied for a change of venue which my EX doesn't want.The case is currently in prince william co VA.Is there a code suppporting my side that I can present to the judge to simplify things? thank you.

Questions of venue for your particular situation are not decided by statute but rather by a judge

of a court of appropriate jurisdiction who will, if necessary, hear both sides, before ruling on the matter in view of the relevant law and facts which have been presented by the parties or known to the court.

If your case is in the J&DRDC of Prince William County, you can simply go(as, apparently, you've already done) to the clerk's office and request to fill out the papers(a motion)to request the transfer of the case to the J&DRDC in Chesterfield. Your spouse will be given notice and the opportunity to oppose it if he so wishes.
