Legal Question in Family Law in Virginia

child support

My military husbband of 14 years walked out on our 4 (10,4, 5, and 8 month old) children and myself in August. The Navy guidelines say he should provide us with 3/5 of his base pay and BAH. The online calculator is stating that his child support would be half of the military guidelines. I plan to ask for alimony as he has a college degree and I have not graduated HS We agreed together that I would be the stay at home mom. He planned these kids as much as I did. We have a home that he currently says he will give me all of the money from the sale of. But so I can decide about how or when to file, what guideline is used to determine his support for the kids? If it helps his base and BAH add up to 78000 a year gross.

Thanks!!

Re: child support

In Virginia child support is dictated by Code Section 20-108.2. There are online calculators as well - go to childsupportguidelines.com and click on Virginia. A rough calculation at $78000 for four kids pursuant to that Code Section wherein he makes $6500 a month he would pay $1777 for four kids. The amount of child support may change if you receive spousal support since that is income to you and reduced from his monthly income.

You need a competent lawyer to help you.

Good luck.
