Legal Question in Family Law in Virginia

Can he contest the adoption?

My husband adopted my daughter 4 years ago. The birth father couldn't be found nor did he respond the the ad in the paper. The judge ordered the adoption final and he also ordered the record sealed and not to be opened by anyone but the court. I am currently trying to find the father for child support arrears. If he is found, could he contest the adoption? Or is the adoption still final whether he likes it or not? I have had no contact with her father for about 10 years now. He had the address to contact me the whole time and chose not to. Please help me I have been trying to get this information for months. Thank you

Re: Can he contest the adoption?

No, the natural father cannot now contest the adoption as long as all of the required procedures were properly followed including the constructive notice to him in the newspaper.

Final adoption decrees in Virginia normally must be appealed within 180 days of the entry of the decree.
