Legal Question in Family Law in Virginia

Custody in Virginia Beach

I have a custody hearing on May 6th. These are the details.

Mom left 7 months ago for a new bf in fla. I was awarded temp custody in Dec. Mom has no visitation out of area. Since then she has gone back and forth between VA and FL. Just recently she has stated she has a job and aprtment in FL. She was ordered to do a homestudy, as far as I know she has not done that yet. I have custody of daughter from previous. Her daughter from previous not living ith her. I have had the 4 bd home, job, and stability I did a homestudy, results pending. She is now claiming I deny visitation and abused her, none of which is true. How likely are the courts to take my 16 month old child from my home to place in a home where mother MAY just now be settled. I one month of stability enough to get her custody and have child moved to FL despite the fact she has paid no support, and has not been constant in our daughters life. Removing her would also have an effect on my 9 y.o. who loves her sister. She feels because she is the mother and just now got a job and place of her own she will get custody. I am pushing for primary w limited visitation for mom based on her instability and past protective order against her. Very worried!

Re: Custody in Virginia Beach

Why worry? If the facts are all(or mostly) as you claim, you should emerge from this hearing having gotten most of what you want.

(However, if you've failed to hire an attorney to represent you in this matter, you may later regret tryin' to take the el cheapo route. Even though most of the facts and equities may be on your side, a failure to properly articulate them before the court could mean an adverse verdict for you.)
