Legal Question in Family Law in Virginia

Divorce Decree

I was divorced from my ex-wife several months ago and in our seperation/divorce decree we agreed to have the payments for a car acquired during the marriage to be her sole responsibility and it hasn't been that way and I want to know what my legal rights are.It was clearly stated that she would be responsible for the remaining balance of the vehicle but I was stuck still making the payments on a car I can't even find.As far as I can tell it was taken for non payment by her because it was her responsibility but after learning she wasn't making the payments I was stuck making payments for this car and my own vehicle and it is ruining my credit and she is simply getting away with it.I simply cannot continue to foot this bill along with all the other debt I have because of her. This one I cannot eat so I was wondering if I had any legal recourse because I need to get out from under this huge debt but I cannot take a repossession on my credit.

Re: Divorce Decree

Your Property Settlement Agreement(PSA) which was incorporated into your final decree of divorce is a contract with continuing enforceability, and if your wife has breached this contract for her failure to maintain the payments on a vehicle for which she was obligated to pay for under the terms of this agreement, then either you or your attorney can have her brought back into court on contempt charges and explain it all to the judge.(And, if in fact she's found in contempt, then appropriate sanctions may be imposed.)
