Legal Question in Family Law in Virginia
divorce proceedures
My wife and I are filing for divorce without counsel. I have the property settlement agreement, the Ore tenus paper and the Final decree paper. Do I need the Complaint form? Is there anything else we need and if you can tell me please, what is the proceedure to follow.

Re: divorce proceedures
Of course you need a Complaint For Divorce; how else would you initiate the divorce action as this document lays out the grounds for the divorce?
You also will need an Acceptance of Service and Waiver of Service, Waiver of Future Service;
A separate form which may be provided by the court to record sensitive personal information such as the social security and bank account numbers of the parties.
A vital statistics form called an Apostille.
You may be able to pick up a packet of forms with instructions from the clerk's office of the circuit court(civil division)which explains how to file a pro se divorce(without an attorney) in the Commonwealth. (This packet should contain forms for each of the aforedescribed documents.)
