guardianship over a sibling

Question: Do I need legal guardianship over my brother in order for him to live with me?

My brother, who is currently 17, wants to live with me for a year. He will be finishing his last year in highschool and entering college the next year. I am currently 22 years old. My mother has also decided that this will be the best for him, for he is currently in need of some fresh starts and new friends, and he is eager to move as well. I am currently a student at a university in NY, and therefore, he will be moving to NY with me. Do I need to gain legal guardianship over my brother in order for him to live with me?

It will be up to the school district in New York

to determine what kind of legal paperwork may be necessary in order for your brother to enroll there

to finish his last year of high school.

You should contact this school district to find out what they may require in this regard. (However, unless there are some very compelling reasons as to why your brother should not finish high school where he currently resides with his mother, this is probably not a wise move for him to make. And, by compelling, I don't merely mean a perceived need on his part for "some fresh starts and new friends".)
