Virginia Separation kit

I purchased the Virginia Separation Kit for your company and my question is: My Separation time for State of Virginia of 6 months will be in a couple of weeks what do I need to do to finalize the divorce. You probably enclosed all the information, but in moving have misplaced the rest of the kit.

I do not work for LawGuru, therefore I don't know much about the "Virginia Separation Kit." However, unless you have some legal background you will probably need to either locate the kit you purchased or hire an attorney to finalize the divorce. The process can be fairly complicated.

Once you have been separated for 6 months (so long as there are children of the marriage) then you can file for divorce with the Circuit Court. You will start off by filing a Complaint for divorce and your separation agreement (required for a divorce after only 6 months of separation). Then you will need to obtain service of process on your spouse or have him or her sign a waiver of service. 21 days after service you should either have the deposition of you and a witness taken or schedule a hearing with the court for the taking of evidence. If you opt for depositions the transcript should be filed with the court. You can then file a Final Decree of Divorce for the judge to sign to finalize the divorce.
