Legal Question in Family Law in Virginia

My husband just left me and my 11 month old son. I don't have a job or any family but his here. My aunt lives in south carolina and wants me and my son to live with her she has already set up a job for me. My husband and I havent filed any paperwork and my question is can i take my son out of state?

Yes, in the absence of any valid court order which would prohibit

such a move on your part or require you at least to give 30 days advance notice of your intended move to both your husband and the court having jurisdiction in the matter (if there be such).
