Minors name change

My ex husband and I have been divorced since 2001 and seperated since 1996. He has never had anything to do with our 2 children of his own free will. He is 20,000.00 past due on his child support. He was convicted or having intercourse with a 14 y/o child in 2006. He is 43y/o. Our children are 13 and 12. They want their last names changed to that of their younger siblings so all of my kids will have the same name.

Ex is currently in prison in WV and I know i have to get him to write a letter and have it noterized stating I can have the childrens last names changed. My question is this. What can I do if he refuses to allow me to change the childrens names?

You can pick up a packet of forms with instructions from certain clerk's offices of circuit courts entitled "Name Change for a Minor"(Virginia Code Sec. 8.01-217)which explains how to petition for the name change pro se without engaging the services of an attorney.

The filing fee for this petition used to be around $30 or so.
