Moving children to another state

I am not legally seperated from my husband, but we are living apart due to his affair. I am a stay at home mother because my infant is terminally ill. I would like to move from Virginia to North Carolina to be closer to family and get some help with the baby. Is it legal for me to move with my children and have my husband stay in virginia

Yes, unless there's currently a court order in effect which would prohibit such a move or one which would require that you first provide advance notice of the proposed move to your husbnd as well as the court.
