Legal Question in Family Law in Virginia

I am the non-custodial parent of a 14 year old daughter. I reside in Virginia. The child and her mother reside in Maryland. If I wish to terminate my parental rights, in which state should I file? And will I still be obligated to pay child support?

You would file in the state with the court in which you were ordered to pay child support.

And, no, if your parental rights were terminated you would no longer be obligated to

pay current child support (altho any accumulated arrearages would still be owed).

You should also be aware, however, that if the sole reason for your seeking to terminate your

parental rights to the child for whom you've been ordered to pay support is to be relieved

of that particular legal obligation, the court might well deny your petition for termiination.
