Legal Question in Family Law in Virginia
settlement question
If you have only been married in the state of Virginia for a year and 3 months,
what can you reasonably expected to get in a settlement? Would we be
entitled to one half of each other's assests after being married for that short a
time? Also, I am not sure if it makes a difference, but we were legally married
in the state of Ohio, but live and always have lived in Virginia.

Whatever assets gave been accululated during the marriage are marital assets and shall be equally split. You never know. Upon marriage Joe Montana of the Washington Redskins deeded all his property to his wife as a gift and upon divorce two years later she was a very rich woman indeed.

Yes you can proceed in Virginia with a divorce. And yes technically any assets or liabilities acquired after the marriage is considered "marital" and is subject to division.
