Legal Question in Family Law in Virginia
Sole Custody
I am in a battle to seek sole custody of my children. Mother was living with me and married someone else, and was still living with me??...had her sign a paper in front of a Notary giving me custody of both my children. She has left with her hubby but I have my children with me.She is now charging me with Vistitation Comtempt...it was in the best interest of the children, that they remain with me. Social Services is involved at this time, and agree that they are in a safe home, being fed and loved and cared for. She was not feeding them and not taking proper care of them. So what are my rights?...

Re: Sole Custody
Better see a lawyer who knows about Virginia family law issues and how they're handled
in the particular jurisdiction where the children currently reside.
Your having had the mother sign a paper in front of a notary purportedly giving you custody of the children means virtually nothing in terms of the law and a legally enforceable custody arrangement. Custody orders from a court of proper jurisdiction are what matter in determining custody issues rather than papers signed by the parties in front of notaries.
