Legal Question in Family Law in Virginia

visitation rights

Good Evening

I have joint custody of my son. I would like to know what kind of visitation rights do I have when pertaining to my child when the child is with the child care provider? I can not get any information from the child card provider. She will not take my phone calls or talk to me.

One incident happened when I called the child care providers home, my son answered the phone, she then took the phone from him and hung it up causing him to cry.

Am I allowed to get my son off the bus and walk him to the child care providers home?

How can I check on the well-being of my son if the child care provider will not talk to me?

Is it o.k for a 14 year old to care for a four year old from 7:00pm to 12:00am three to four times a week?

Thank you

Re: visitation rights

Your visitation rights are likely(unless there's

a subsequent order regarding this issue)whatever is referenced in the joint custody order.(I assume that you mean to say that you share legal custody of your son with the other parent but that the latter has sole physical custody of the child.)

If the language regarding your right of visitation is general in the court's order then whatever is reasonable under the circumstances should be a fair construence.

You, apparently, need to have a talk with the

other joint custodian to work out the problems which you've described.(A change of care providers may be in order.)
