Legal Question in Civil Litigation in Virginia

My 16 year old daughter reported to her high school band teacher that she was being continually sexually harassed by a fellow band member. The band teacher told the boy and my daughter to stay away from each other and left it at that. He did not report it to an administrator. My daughter told me today that this same boy sexually assaulted her after a band event two weeks ago. I have spoken to our local D.A., and my daughter is going to be interviewed by a deputy tomorrow. Do I have any legal recourse against the school or this teacher?

I am sorry to hear this.

Possibly, but the case could be difficult and expensive. They may put up an immunity defense, etc. Its possible, if the facts are provable, that they may settle any claim. You really need to talk to some attorneys before you do anything.

Good luck.
