car payoff need title

we refinanced our home, in doing this the compnay paided off our car.i called and spoke with someone to get the amount and the address to send the payment since this is diffrent from the regular payment.that was on dec 31 of this year the company received it jan 8 2004. they then reposed my car on the jan 14 04. now the company want us to pay 1057 in order to get the title and $445 for repos fees. we receive a statement each month and this is what they say is outstanding. our car was to be paid for in 36months no penalty if we paid it off early already check that. so now the statement for may have all the payments i spoke about and a payment of$403 due may 2006. i've gotten two different payment statement from the company which both being different. evening after the car was returned we received letter telling us what we needed to do to get the car back. i'm really at wit ends to what we can do at this point. to get our title and get these people off our back. thank you

It is unclear what you are asking from the information you

provided. Sounds like the repo occurred after you paid your

entire balance due EARLY on the car. If the repo proceeded despite

this payment in full, it is possible that the repo was

done erroneously and that you should not pay the charges. You should see an

attorney about this if you feel you are not making any

progress. You should consult with an attorney who practices

in the area of consumer law.

Re: car payoff need title

The repo may have violated the Fair Debt Collection Practices Act. The Act provides for attorney fees to be recovered, so you may well be able to find an attorney in your area to take your case without an advance payment.
