Legal Question in Civil Litigation in Virginia
My family has a burial lot, located on the private cemetary of a church. The headstone was damaged.Who is responsible for the damage. The church charges a yearly fee for the up keep and maintenance of the lot. The damage appears to have been done by the lawn care person. The headstone was knocked over onto the vaults and cracked. the lawn care person does not accept responsibility and the church is not sure if the cemetary damage would come under the church insurance policy, I just want my families headstone repaired or replaced... Please Help Me.
1 Answer from Attorneys
Tell the church that you want the damage to the headstone submitted as a
claim under their insurance policy apparently caused by their employee
during the course of his employment with the church.
And, if they refuse, then tell them you'll see them (or their attorney) in court.
