Legal Question in Immigration Law in Virginia

Is it possible for a UK man who has been convicted of rape and indecent asault of a female under the age of 16 to permanently reside in the USA. He has met an american woman who he wishes to live with and they wish to set up a business and get married.

To further elaborate, the individual was charged with above convictions over 10 yrs ago with no time served and the sentence being probation over 2 years concurrent. In addition, no charges were brought against the individual by the victim but occurred as a result of individual turning themself in to authorities voluntarily and was prosecuted by the CPS
