Legal Question in Employment Law in Virginia
Christian?
Our church is hiring a secretary. In addition to advertising for the position in the church bulletin, we advertised in two local newspapers. When interviewing, are we allowed to ask if an applicant is a Christian?

Re: Christian?
You may not advertise a job dependant upon religion unless the position falls within the very limited exception--a Bona Fide Occupational Qualification. For example, you may require the minister be christian. However, this is an exception that is very narrowly applied, and will not apply where religion is not an essential element of the position--eg. the secretary. I would highly caution to not advertise in this manner without having an attorney directly review the facts of your situation.
