Legal Question in Employment Law in Virginia
HR Contractor
I was contacted by my former employer to come back as a contractor to help train their new HR person. After I finished training this person, employer asked me to stay to document job processes. During this time the HR person was out for a death in the family. She returned & then ultimately left w/out notice (1 mo after start job). Employer had paid her for time missed as a result of a death. Employer had stated in employees offer ltr that employee would not be paid for absences before end of a 90 day probat period, but, paid her anyway. Employee has not recd her final check & is owed for work performed (although there is debate as to how many days she worked & was not paid. She thinks 5 days & the employer thinks 3 days. Supervisor did not keep records, so there is no written docum.). Employer didnt want to pay anything at 1st.Now, employer wants me, the HR contractor, to write a ltr informing employee she will receive a check for 3 days worked & he wants to attached offer ltr stating that he was a ''nice'' guy & paid her bereavement leave when he didn't have too. As a contractor, I do not feel comfortable w/writing the ltr. Especially w/out documentation & I am not employee. What are my legal options to refuse writing ltr

Re: HR Contractor
I don't see why you should be concerned about assisting your former employer with merely drafting this letter, as long as he signs it along with whatever attachments which need to be signed.
