pay or quit-rental

I received a pay or quit from landlord saying I needed to leave on 1/17/09 by 12 noon. This is after I already told them in writing I'd be out by Feb. 1st. From what I know legally I can stay because they have to proceed with eviction after that notice correct? Help me thanks

Yes, the landlord must follow the procedures legally required to evict you from the premises.
