Rental Lease

My son is renting an apartment w/ a 1 year lease. Tenants below are smoking and the smell is making my son very sick. Landlord said nothing he can do because it doesn't state in the lease that you can't smoke. Landlord told them when they moved in that you can't smoke. Landlord told me he hopes they burn the place down since it stinks so bad now. Other tenants are complaining of smoke smell too. Can my son get out of his lease early and get his security deposit back? He is allergic to cigarette smoke and has been since he was a baby. Thank you for any help you can give us.
