Legal Question in Landlord & Tenant Law in Virginia

Are We Responsible For This?

When I was moving out my bedroom

furniture we noticed the carpet under

my bed was soaked. It was concealed

until the furniture was moved. My

room was in the basement and the

air condition unit was in the room

behind mine. We called the plumber

to fix a pipe (landlord paid for that)

andI got the carpet somewhat dry

and there was light staining. The

landlord is trying to charge us for a

new carpet. It was his air condition

unit and we reported it as soon as we

saw the damage. I have a witness to

say the carpet damaged could not be

seen until the bed was moved.

also is $800 too much for a medium

sized room anyway? he has not even

been back to the house to see the

damage in person. he didnt do a

walkthrough with us. also, i believe

he has to include how old the carpet

is and the life expectancy and

subtract that from the cost.

Re: Are We Responsible For This?

You should write the landlord a clear and concise explanation as to why you should not be held responsible for the rug damage under these particular circumstnces. Then keep a copy for your record to facilitate your defense in case he decides to sue you.
