I have a tenant that was on a verbal month to month lease. This tenant has recently decided to move giving me a 2 weeks verbal"only" notice. Their was also a verbal agreement made in December that the tenants would be resigning the lease for the following year. Should this tenant receive any or all of the deposit money back. The tenants have not paid the full amount of the rent for the month that they have been living in the rental property.

Month to month leases normally require 30 days advance notice from either party regarding termination of such lease. Assuming that such is the case with the tenancy which you've described, then these tenants could be in material breach if they leave, having given you only two weeks advance notice.
